FREE SPIRIT TRAVEL DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY
ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER FREE SPIRIT TRAVEL OR
LAW ENFORCEMENT AUTHORITIES.

You hereby certify that you are at least 18 years old. If you are under 18, please do not use www.freespirittravel.net, any of our subscription or any of our other services.

We do not knowingly collect any personally identifiable information from any person under 18 years old.

GOVERNING LAW
These Terms of Use will be governed and interpreted pursuant to the laws of the State of Georgia, notwithstanding any conflicts of law.

You specifically consent to personal jurisdiction in Georgia in connection with any dispute between you and us. The parties to these Terms and Conditions each agree that, subject to the  arbitration requirement, the exclusive venue for any dispute between the parties arising out of or relating to Free Spirit Travel or these Terms and Conditions will be in the state and federal courts in Atlanta, Georgia provided that Free Spirit Travel may elect to bring an action against you in any applicable jurisdiction if you fail to submit to jurisdiction and venue in Atlanta, Georgia or to enforce any award or order.

You agree that any suit, action or proceeding arising out of or relating to these Terms and Conditions, Free Spirit Travel, or any of the transactions contemplated herein (including, without limitation, statutory, equitable or tort claims) shall be resolved solely by binding arbitration before a sole arbitrator under the rules and regulations of the American Arbitration Association (“AAA”);
provided, however, that notwithstanding the parties  decision to resolve any and all disputes arising under these Terms and Conditions through arbitration, Free Spirit Travel may seek to obtain injunctive relief or other equitable relief from a court to enforce the provisions hereof or the decision of the arbitrator.

The arbitration shall be held in Atlanta, Georgia. The arbitrator shall apply the substantive laws of the State of Georgia, shall issue a written decision, and shall have the power to award any legal remedies except for punitive damages. The parties will split the arbitrator’s fee. You irrevocably waive any rights to bring or participate in any class action related in any way hereto. If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity or enforceability of any remaining provisions.

These Terms and Conditions constitute the entire agreement relating to this subject matter. Notwithstanding the foregoing, any additional terms and conditions on this site will govern the items to which they apply.

We may revise these Terms and Conditions at any time.

a. Free Spirit Travel may share your Personal Information (only to the extent reasonably
necessary or as required by the circumstances) and Aggregated Data, when applicable, with the following parties:
(i) Third-party vendors and preferred suppliers, in order for such parties to (1) assist Free Spirit
Travel in providing the requested travel services to you, (2) provide aggregate reporting to Free
Spirit Travel and certain third parties (using only Aggregated Data and not individual Personal
Information when provided to third parties), and (3) provide 24/7/365 emergency customer
support for certain eligible clients.
(ii) Those highly regarded vendors and preferred suppliers with which Free Spirit Travel has
alliances so that you may receive information about exclusive offers or other luxury products
and services in which you may be interested (but if you do not wish to receive marketing
communications from those parties, please contact us at [email protected] and/or by
unsubscribing;
(iii) Non-affiliated third-party vendors and service providers which provide certain services or
functions requested by you and/or which fulfill your requested transactions, including, but not
limited to, hotels, airlines, cruise lines, tour operators and car rental companies, as well as
service providers who assist with our business operations (such as fraud investigations, bill
collection and affiliate and award programs).
(iv) Other third parties to whom you explicitly ask us to send your information (or about whom
you are otherwise explicitly notified and consent to when using a specific service).
(v) The appropriate parties if it is requested by a government agency or law enforcement
personnel or if we are otherwise required by law to disclose it in response to subpoenas, court
orders, or other legal process, to establish or exercise our legal rights, to defend against legal
claims, or as otherwise required by law (in which case, we reserve the right to raise or waive
any legal objection available to us).

(viii) The appropriate parties when we believe in good faith that disclosure is required to
protect the security, property, assets and/or rights of Free Spirit Travel from unauthorized use

Free Spirit Travel may provide third-party links, or otherwise cooperate with third parties, to
provide you with access to online booking tools. These online booking tools are owned and
operated by third- party providers and are not under the control of Free Spirit Travel. Free Spirit
Travel may provide access to these online booking tools as a service to you, and is not
responsible for their operation, content, information practices or any link contained in a linked
site. These tools often gather personally identifiable information and financial information from
you to complete your booking requests, and our service may include some of your Personal
Information in the link to the booking tool to help streamline the booking process.
